Welcome to PHIN. These Terms of Service ("Terms") govern your access to and use of phinkafi.ch (the "Site") and any purchase you make from us. By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

PHIN KLG is a Kollektivgesellschaft (Swiss general partnership) registered in the Swiss Commercial Register (No. CH-020.2.010.179-9, UID CHE-446.665.092), based at Tösstalstrasse 227, 8405 Winterthur, Switzerland. The Site is built on Shopify, which provides the underlying e-commerce platform.

2. Eligibility & Accounts

You must be of legal age in your place of residence to place an order, or have the consent of a parent or guardian. If you create an account, you are responsible for keeping your login details secure and for all activity under your account.

3. Our Products

We make every effort to describe and display our coffee and accessories accurately, including tasting notes, roast, and packaging. Actual color and appearance may vary slightly depending on your screen. We may update product descriptions, discontinue products, or limit order quantities at our discretion.

4. Orders & Pricing

Placing an order is an offer to purchase, which we may accept or decline. An order is only confirmed once we send you an order confirmation email. Prices are shown in CHF and are current at the time of order; they exclude any applicable taxes, duties, or import charges unless stated otherwise. Prices, discounts, and promotional codes (such as FIRST15) may change at any time without notice.

5. Payment

You agree to provide accurate and complete payment information. Payments are processed securely via Shopify and our payment processors — we do not store your full card details.

6. Shipping & Delivery

We currently ship within Switzerland only, via Swiss Post, with standard (2–3 business days) or express (1–2 business days) delivery, plus an optional Executive Hand-Delivery service. Orders over CHF 60 ship free. Full details are in our Shipping Policy. We are not liable for delays caused by the carrier, customs, or events outside our control. Once an order is handed to the carrier, risk of loss passes to you.

7. Subscriptions

If you subscribe to receive recurring coffee deliveries, you'll save 12% on each order. You can pause, skip, change frequency, or cancel your subscription at any time via the link in your order confirmation email. Full details are in our Subscription Policy.

8. Returns & Refunds

Returns and refunds are handled in accordance with our Refund Policy, including the 30-day return window and the 14-day cooling-off right for orders shipped into the EU.

9. Intellectual Property

All content on the Site — including the PHIN name, logo, product names, photography, and text — is owned by PHIN or its licensors and protected by Swiss and international intellectual property law. You may not reproduce, distribute, or otherwise use this content for commercial purposes without our prior written permission.

10. Acceptable Use

You agree not to use the Site to: violate any applicable law; infringe our or anyone else's intellectual property; harass, defame, or harm others; transmit spam, malware, or fraudulent content; impersonate any person or entity; or use bots, scrapers, or automated tools to access the Site without our permission. We may suspend or terminate access to the Site for anyone who violates these Terms.

11. Third-Party Links

The Site may link to third-party websites we do not control. We are not responsible for their content, accuracy, or practices, and linking to them does not imply our endorsement.

12. Disclaimer & Limitation of Liability

The Site and its content are provided "as is" without warranties of any kind, to the fullest extent permitted by Swiss law. We do not guarantee the Site will be uninterrupted or error-free. To the extent permitted by law, PHIN is not liable for indirect, incidental, or consequential damages arising from your use of the Site or our products, except where such liability cannot be excluded under mandatory Swiss law (for example, in cases of gross negligence or willful misconduct).

13. Indemnification

You agree to indemnify PHIN against any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on this page. Continued use of the Site after changes are posted means you accept the updated Terms.

15. Governing Law & Jurisdiction

These Terms are governed by Swiss law. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts at PHIN KLG's registered seat in Winterthur, Switzerland, to the extent permitted by applicable consumer protection law.
